In a\u00a0<strong>7-4 decision<\/strong>, the court said Trump overstepped by using emergency powers to impose tariffs of \u201cunlimited duration\u201d on nearly all imports from nearly every country. The ruling upheld an earlier court decision and could disrupt trade talks already in progress.<\/p>\n<p>Despite the ruling, the\u00a0<strong>tariffs will remain in effect until October 14<\/strong>\u00a0to allow time for further appeals. Trump has already announced plans to take the case to the\u00a0<strong>Supreme Court<\/strong>, leaving U.S. trading partners in a \u201cwait and see\u201d mode as legal proceedings continue. Until then, duties will still be collected under the contested executive orders.<\/p>\n<p>Two major outcomes of the ruling were clarified. First, the so-called\u00a0<strong>\u201cliberation day\u201d tariffs<\/strong><\/p>\n<p>are currently deemed unlawful. Second, although illegal, the tariffs will stay in place temporarily to allow other legal challenges to be reviewed. If the Supreme Court agrees they\u2019re illegal, the U.S. may be required to\u00a0<strong>refund collected tariff revenue<\/strong>.<\/p>\n<p>Importantly, the decision\u00a0<strong>does not apply to all tariffs<\/strong>. It excludes Trump-era duties on\u00a0<strong>steel and aluminum<\/strong>, which remain unaffected. However, the\u00a0<strong>World Trade Organization (WTO)<\/strong>\u00a0has already found some of Trump\u2019s broader trade measures to be illegal, and those are now under appeal via international channels.<\/p>\n<p>The decision also did\u00a0<strong>not reverse the end of the de minimis exception<\/strong>, a policy change that caused global postal disruptions. If the ruling stands,\u00a0<strong>tariff rates on low-value imports<\/strong>\u00a0could return to pre-\u201cliberation day\u201d levels, often meaning\u00a0<strong>zero tariffs<\/strong>\u00a0on such goods.<\/p>\n<p>Trump criticized the ruling on Truth Social, calling the court\u00a0<strong>\u201chighly partisan\u201d<\/strong>\u00a0and warning that removing tariffs would\u00a0<strong>\u201cdestroy\u201d the U.S. economy<\/strong>.
